Professor Nicholas Quinn Rosenkranz of Georgetown University will be discussing the upcoming U.S. Supreme Court case, Bond v. United States.
Missouri v. Holland has been interpreted to hold that Congress has power to enact legislation to implement a treaty, even if it would lack that authority absent the treaty. But as the United States expands its commitments under international law on matters of distinctly local concern, the question of whether Congress can expand the scope of its legislative authority via treaty agreement has taken on growing significance. The U.S. Supreme Court will have the opportunity to revisit the question this term with the upcoming case of Bond v. United States.Registration details:
