With litigation becoming increasingly complex, and the addition of mass tort and class action litigation, costs of bringing and defending lawsuits are rising. With the rise of technology, written communication via e-mail, text, and other formats is less and less costly. At the intersection of these two dynamics lies an interesting question: Who should bear the costs of retaining, cataloguing, searching, retrieving, and producing "documents" in litigation? Does it matter that the mere costs of discovery are in some cases now being seriously considered as parties weigh decisions about whether to settle?
