On August 21 in EME Homer City Generation v. EPA, the Court of Appeals for the D.C. Circuit struck down the EPA’s Transport Rule or the Cross-State Air Pollution Rule, stating that the CSAPR “exceeds the agency’s statutory authority in two independent respects.” The Court instructed the EPA to “continue administering CAIR (the ‘Clean Air Interstate Rule’) pending promulgation of a valid replacement.” The experts on today’s call will provide background on the underlying rules, the resulting litigation, and next steps.
