In recent years, there has been a surge of putative class action lawsuits filed against food manufacturers for alleged false advertising. These lawsuits allege that food manufacturers have misled consumers about the nutritional profile and ingredients of popular packaged food products and drinks. This teleforum will discuss this new trend in class action lawsuits, potential defenses against these actions, recent case law in this area, and new scrutiny in this area by the Federal Trade Commission, the Food and Drug Administration, and the U.S. Department of Agriculture.
