On the heels of the U.S. Supreme Court decisions finding the federal Defense of Marriage Act to be unconstitutional and leaving an order intact striking California’s same sex marriage ban, Al Gerhardstein obtained a court order requiring Ohio to recognize the marriage of his clients on the theory that Equal Protection requires Ohio to recognize the marriage. Is the decision correct? Are all states now required to recognize same sex marriage as a matter of Constitutional Law?
To debate the issue, we are pleased to host Mr. Gerhardstein, a locally prominent civil rights attorney and the attorney for the Ohio couple, and John Eastman, Dean Emeritus of Chapman University School of Law, director of the Center for Constitutional Law at the Claremont Institute and Chairman of the National Organization for Marriage.
