Vincent J. Vitkowsky

Vincent J. Vitkowsky serves domestic and international insurers and reinsurers in litigation, arbitration, and counseling of coverage and claims matters, reinsurance disputes, direct defense, and commercial disputes. He also advises on matters involving cyber risks, liabilities, and exposures. Outside the insurance industry, Vince serves as counsel or arbitrator in a broad range of international commercial arbitrations.

Vince represents clients in direct insurance coverage matters and claims litigation, in lines such as professional liability, management and D&O, energy, entertainment, terrorism, life and group health insurance. He represents clients in reinsurance disputes in virtually all lines of business, addressing all commonly recurring issues, as well as unique points of contract interpretation, and in disputes concerning catastrophe bonds. He also represents insurers, reinsurers and brokers in commercial litigation matters such as post-acquisition purchase price disputes, alleged business torts, breach of trade secrets, matters involving runoff companies and managing general agents, and disputes with state Liquidators of insolvent insurers.

Vince’s background in cyber risks, liabilities, and exposures developed from his distinctive skill set as an insurance lawyer with extensive knowledge of national security and public policy.  He applies his knowledge of insurance, terrorism, international and national security law, and the law of war to analyzing exposures involving data breaches, industrial and other cyber attacks with kinetic effects, extortion, hacktivism, and terroristic threats. He provides counsel on matters such as exclusions or grants of coverage for war and terrorism risks under cyber policies. Also in the area of national security, Vince assists clients in complying with their obligations under the OFAC economic sanctions regime.

Vince has served as counsel in well over 100 arbitrations involving insurance and reinsurance. In addition, he has served as counsel or arbitrator in international commercial arbitrations involving agency, sales, distribution, licensing, technology development, employment, joint venture, shareholder and other contracts, in industries such as financial services, aviation, textile and apparel, telecommunications, entertainment, champagne and real estate development. He is a member of the Panel of Arbitrators of the AAA International Centre for Dispute Resolution.

Vince’s practice is national and international. He has appeared pro hac vice in courts across the U.S., and has assisted in arbitrations in several countries. Vince has been counsel in 15 reported decisions involving insurance, reinsurance, and arbitration law. He has argued appeals in four federal circuits.

Over the years, Vince has been selected for inclusion in many leading lawyer directories. Chambers America’s Leading Lawyers for Business has described him as “a well-prepared operator,” and noted that “clients appreciate his intelligence and tactics, which make a tough case seem a lot more manageable”. The International Who’s Who of Business Lawyers described him as “renowned for his litigation and dispute resolution counsel”.
