Homeschooling Battle in California

A constitutional crisis hit California this spring, although it was noticed more for its social than legal significance. On February 28, 2008, in the case In re Rachel L., the Second District Court of Appeal in Los Angeles, California, found that the state’s truancy statute prohibited homeschooling without a teaching credential for the grade taught: under California case law “parents do not have a constitutional right to home school their children.”
