On November 4, 2009, the Supreme Court heard oral argument in Pottawattamie County v. McGhee. The issue in this case is whether a prosecutor is absolutely immune from civil liability in a suit brought by a criminal defendant who alleges that the prosecutor violated a criminal defendant's substantive due process rights by procuring false testimony during the criminal investigation and introducing it at trial.
