On April 16, 2008, the Supreme Court heard oral argument in Kennedy v. Louisiana. The Court was asked to consider whether Louisiana's law authorizing the death penalty for child rape violates the 8th Amendment's Cruel & Unusual Clause. Bill Otis, former Chief of the Appellate Division in the U.S. Attorney's Office for the Eastern District of Virginia, discusses the case.
