Applying judicial engagement includes rejecting simple rational basis review acknowledges the role of judges in recognizing and enforcing constitutional limits on the power of government. The U.S. Constitution trumps precedent and does not merely mean what a judge or panel of judges says it means/meant. Rather, it guarantees a broad array of individual rights and of limits on governmental power.
